What To Expect When We Notarize Your Durable Power of Attorney

Durable Power of Attorney (DPOA) is our most common notarization. Mobile notaries are often called on-site, to hospital rooms or homes, to help complete the necessary forms. The purpose of a DPOA is assign someone else to act on behalf of an incapacitated person in financial matters and health care.

The person who is signing and designating control over their affairs is called the Principal.

The person who is appointed by the Principal to act on their behalf is called the Agent or Attorney in Fact.

Don’t worry if the Principal can’t sign their full signature. The signature does not have to be complete or perfect. However, you will need a form of identification for both the Agent and the Principal.

Durable Power of Attorney for Health Care

In both Kansas and Missouri, often require two witnesses. Sometimes Kansas DPOA’s don’t.

Witnesses can not be:

  • the Agent
  • relatives, by blood, marriage or adoption
  • anyone who financially responsible for the Principal

Witnesses must:

  • be age 18 or older
  • have a form of identification

Also, please have witnesses chosen in advance, because many hospitals and assisted living facilities prohibit their staff from witnessing signatures.

You can always request that we wear masks and other PPE, because we respect the health of the Principal and their loved ones in a time when health can be fragile.

All signers (witnesses, Principal and Agent) will also be asked to sign the notary’s journal as Kansas has a legal requirement for notaries to maintain a journal, while Missouri strongly recommends it for traditional notarizations.
